Delos Privacy Policy

This Privacy Policy explains how AIFIXMY LLC, a New Jersey limited liability company ("AIFIXMY," "Delos," "we," "us," or "our"), collects, uses, discloses, retains, and protects information through the Delos mobile application, website, and related services (collectively, the "Service").

1. Scope and eligibility
The Service is intended only for people who are at least 18 years old. We do not knowingly permit minors to create accounts. If we learn that a minor has provided personal information, we may suspend the account and delete the information, subject to lawful preservation obligations.
This Policy does not govern third-party services that users independently visit or link from their profiles.
2. Information we collect
Information you provide
- Account information, including email address, authentication records, and account identifiers.
- Profile information, including display name, age, biography, general location, instruments, genres, influences, skills, experience, availability, goals, travel radius, transportation, equipment, band membership, and public music links.
- User content, including profile images, audio, video, messages, Band Calls, applications, rehearsal proposals, setlists, tasks, notes, reports, and communications with support.
- Transaction information, including subscription tier, product, purchase status, renewal status, and provider identifiers. Delos does not receive full payment-card numbers from Apple or Stripe.
- Safety and verification information you choose to provide in connection with reports, appeals, or investigations.
Information collected automatically
- Approximate location, when you grant permission, to calculate distance and populate a city/region label. We do not intentionally display precise coordinates to other members.
- Device and technical information, such as operating system, app version, device type, language, IP address, timestamps, push-notification token, and security logs.
- Product-interaction information, such as onboarding completion, discovery actions, matches, messages, proposals, Band Call activity, subscription interactions, and private rehearsal outcome confirmations.
- Diagnostics and crash information if diagnostic services are enabled in the released build.
- Local app preferences stored on your device, including demo-mode and notification settings.
Information from others
We may receive reports and content concerning you from other users; subscription and entitlement information from Apple, RevenueCat, or Stripe; authentication and database events from Supabase; and security or legal information from service providers, authorities, or rights holders.
3. How we use information
We use information to:
- create, authenticate, secure, and administer accounts;
- operate profiles, discovery, compatibility scoring, matching, messaging, Band Calls, rehearsal tools, notifications, and subscriptions;
- calculate recommendations using disclosed compatibility factors such as genre, role, distance, schedule, commitment, and goals;
- personalize settings and enforce usage or subscription limits;
- process purchases, restore entitlements, and prevent fraud;
- moderate content, investigate reports, enforce our agreements, and protect users and the public;
- provide support and communicate about the Service;
- debug, secure, analyze, and improve the Service;
- comply with law, preserve evidence, and establish or defend legal claims; and
- create aggregated or de-identified insights that are not reasonably capable of identifying an individual.
We do not sell personal information for money. We do not use personal information for cross-context behavioral advertising, and we do not intentionally use sensitive information to infer characteristics unrelated to providing the Service.
4. How information is disclosed
To other members
Your visible profile, general location, compatibility information, availability indicators, public links, Band Calls, and content you intentionally share may be visible to eligible members. Mutual matches and accepted Band Call participants can access conversation content. Shared-room participants can access its setlists, tasks, and notes. Your private email address and precise coordinates are not intended to be public.
To service providers
We may disclose information to providers that host or support the Service, including:
- Supabase for authentication, databases, storage, server functions, and realtime messaging;
- Expo and Apple Push Notification service for builds and notifications;
- Apple and RevenueCat for iOS subscriptions and entitlement management;
- Stripe for web subscriptions and billing management;
- Sentry, only if enabled, for diagnostics and crash reporting; and
- professional advisers and vendors supporting security, legal, accounting, customer support, and operations.
Providers may process information only under their own terms and our instructions or as independently required by law. The final production vendor list must match the technologies enabled in the released build.
Other disclosures
We may disclose information:
- when you direct or consent to the disclosure;
- to investigate abuse, fraud, infringement, threats, or violations;
- to comply with subpoenas, court orders, lawful government requests, or other legal duties;
- when reasonably necessary to protect rights, safety, property, users, AIFIXMY, or the public;
- during financing, due diligence, merger, acquisition, reorganization, bankruptcy, or transfer of the Service, subject to appropriate protections; or
- in aggregated or de-identified form.
We do not guarantee that another user will not copy or redistribute content you make visible to them.
5. Legal bases outside the United States
Where applicable law requires a legal basis, we process information to perform our contract with you, pursue legitimate interests such as security and product improvement, comply with legal obligations, and act with consent where required. You may withdraw consent without affecting prior lawful processing, although some features may then be unavailable.
6. Retention
We retain information for as long as reasonably necessary to provide the Service, fulfill the purposes above, comply with legal and accounting duties, resolve disputes, and enforce agreements. Typical targets are:
- active account and profile data: for the life of the account;
- deleted-account content: removed from active systems promptly and ordinarily from backups within 90 days;
- routine technical and product logs: ordinarily up to 24 months;
- billing and tax records: up to 7 years or longer if legally required;
- safety reports, enforcement records, fraud records, and preserved evidence: as long as reasonably necessary for safety, legal claims, repeat-offender prevention, or legal obligations.
Deletion may be delayed where information must be preserved by law, is necessary to protect users, or cannot reasonably be isolated from backups. We may retain de-identified information indefinitely.
7. Your choices and rights
You can edit profile and discovery settings, disable notifications through device settings, pause discovery visibility, block users, remove media, and delete your account in Settings. Account deletion is available to all users. If an Apple subscription is active, deleting Delos does not automatically cancel billing through Apple; cancel it in Apple subscription settings.
Depending on where you live, you may request access, correction, deletion, portability, restriction, objection, withdrawal of consent, or an appeal of a denied privacy request. You may also have rights concerning sale, sharing, targeted advertising, profiling, or sensitive data. Delos does not currently sell personal information or use it for cross-context behavioral advertising.
Submit requests at support@delosmusic.app or https://delosmusic.app/privacy-choices. We may verify your identity and authority. Authorized agents must provide proof of authorization. We will not discriminate against you for exercising applicable rights.
8. Security
We use reasonable administrative, technical, and organizational safeguards, including access controls, private storage, encrypted transport, and database authorization policies. No system is completely secure. You are responsible for protecting your credentials and for promptly reporting suspected account compromise.
9. International processing
The Service and its providers may process information in the United States and other countries whose laws differ from those where you live. Where required, we use recognized transfer mechanisms or other safeguards.
10. Children
Delos is not directed to anyone under 18. Report a suspected minor account to support@delosmusic.app.
11. Changes
We may update this Policy. We will post the revised version and update the date above. If changes are material, we may provide additional notice where appropriate or legally required.
